Portuguese prison guard Jose Carlos Martins has won a major legal victory after the South Central Administrative Court confirmed a ruling declaring his compulsory retirement invalid.
The decision by the appellate court upheld an earlier judgment from the Administrative Court of Sintra, which had previously ruled that the decision to retire Martins was null and void.
However, Martins cannot immediately return to his post as a prison guard because an appeal has been lodged with Portugal's Supreme Court, keeping his reinstatement on hold.
Decade of legal dispute
Martins was compulsorily retired in May 2011 while working as a prison guard at the Tires Prison Establishment in Cascais.
Following his forced retirement, Martins initiated legal proceedings to overturn the decision. He has spent more than a decade waging a continuous legal battle to be readmitted to his former role in the prison system.
Court decisions and Supreme Court appeal
The administrative legal process began with a challenge at the Administrative Court of Sintra, where judges initially ruled in favour of Martins by declaring his forced retirement null.
That decision was subsequently appealed to the South Central Administrative Court, which reviewed the case and confirmed the Sintra court's finding that the retirement order had no legal validity.
Despite securing favorable decisions in two administrative courts, Martins remains unable to resume his duties. The submission of a further appeal to the Supreme Court suspends the execution of the judgments, delaying his return to work until the highest court reaches a final determination.
