A French consumer named Jean-Pierre from Hergnies, in the Nord department, has been left struggling to enforce an extended warranty on a fridge freezer after the online retail site where he bought the appliance entered judicial liquidation.

Jean-Pierre purchased the appliance alongside a five-year extended commercial warranty, which ran from August 8, 2021, to August 8, 2026. However, when he contacted the insurance company providing the coverage, representatives said they could not locate his contract because the defunct seller failed to declare the sale.

The insurer told Jean-Pierre that it could not initiate any intervention without a registered sale on file. The case was analyzed on air by consumer journalist Ani Basar during the television program Le 13H a vos cotes, hosted by Isabelle Ithurburu on French network TF1.

Le 13H a vos cotes is a daily consumer assistance segment broadcast as part of TF1's flagship midday news coverage, designed to solve viewer disputes. In France, commercial extended warranties are optional insurance policies separate from statutory legal guarantees, often underwritten by third-party insurers rather than the retailer itself.

Contract Terms Determine Policy Holder Protection

Basar explained that Jean-Pierre's options depend entirely on the specific contract established between the online vendor and the underwriting insurer. If the agreement mandated that the seller declare every transaction to activate coverage, the policy was never officially established, leaving Jean-Pierre with no recourse against the insurer.

In that scenario, Jean-Pierre's sole remedy would be to file a claim against the retailer directly. Because the e-commerce business has been liquidated, the company no longer exists and cannot compensate him.

If the contract between the vendor and the insurer did not make seller declaration mandatory, the process becomes significantly simpler. Under those terms, Jean-Pierre can present his purchase invoice and warranty certificate directly to the insurer to have the fridge freezer repaired or replaced at the insurer's expense.

Deadlines and Out of Court Negotiations

According to general sales conditions consulted for the broadcast, customers can report a claim by phone or email. Jean-Pierre took that step on July 15, 2026, well ahead of the policy expiration date.

Although the five-year warranty officially expired on August 8, 2026, the formal prescription deadline could only be suspended by sending a registered letter with acknowledgment of receipt before that date. Jean-Pierre did not send the registered letter prior to August 8.

Because he notified the insurer before the deadline, Basar noted that Jean-Pierre still holds grounds to negotiate an amicable settlement out of court. Under French procedure, registered mail with return receipt, known as a courrier recommande avec accuse de reception, serves as the standard legal trigger to halt statutory deadlines.

Potential Criminal Liability for Defunct Company Executives

Turning to the court-appointed liquidator of the failed website offers no relief, as liquidators cannot assist individual customers in such disputes. However, the executive leading the online store can face personal criminal prosecution if they knowingly sold non-existent warranty contracts.

Under French law, intentionally marketing fraudulent warranty policies constitutes deceptive commercial practices or fraud. If convicted, business executives face up to five years in prison and a fine of 375,000 euros.
