The ruling of the British Supreme Court, according to which the concept of woman in equality law is based on the biological sex means that trans women with gender recognition certificate (GRC) may be excluded from spaces intended for one gender, provided this is “analog”. The Chairman of the Equality and Human Rights Committee (EHRC), Baroness Kiser Falcner, described the Supreme Court’s ruling as “great and decisive” and pledged to seek to impose the compliance of organizations that do not review their policies in accordance with it. On issues such as toilets, changing rooms and sports, Baroness Falcner has agreed with the government that the decision was “clarified” for the obligations of service providers regarding one gender, under the law on equality.
