The city claims that the unions have not exhausted the negotiation stage and set out to call “numerous stoppages that will compromise and are already compromising the public service and attention to the students served”.
Among the main claims, the municipal teachers and employees unions of education reject the proposal of the government of the general revision of the annual revision of 2.6% of salaries from May 1st this year, and ask for increase in remuneration .
The court considered the Federal Constitution, which guarantees workers the right to strike, but cited Article 10 of Law No. 7,783/1989, which defines that the provision of essential public services cannot be interrupted under penalty of irreparable damage to the population.
São Paulo argues that the strike would affect the study, food and hygiene of students enrolled in the municipal network, as well as the routine of parents and family – and asked the court to be the presence of 70% of teachers under penalty of R $ 1 million to the class.
Judge Artur Cesar Beretta da Silveira prioritized the interest of local society to the detriment of workers’ rights, stressed that Strike must be exceptional and accepted the request with the reduction of the fine.
The court considered the proximity of a negotiation at the conciliation hearing scheduled for next Wednesday (23).
