TRE-SP welcomes PT appeal and bars electoral transfer from Moro to SP

The Regional Electoral Court of the State of São Paulo (TRE-SP) welcomed, this Tuesday (7), the PT’s appeal against the decision that approved the request for transfer of electoral domicile of former judge and former minister Sergio Moro. from Curitiba to the capital of São Paulo.

As a result, Moro’s transfer was rejected.

Moro requested the transfer on March 30, and it had been approved by the 5th Electoral Zone – Jardim Paulista, west of São Paulo.

The PT argued that Sergio Moro indicated that he resided in a hotel in the capital, which would not represent “ties with the state of São Paulo, nor with the city” and that the transfer does not have the objective “only of exercising citizenship, but of apply for the 2022 election.

The name of the former judge was considered as a candidate for the Senate by São Paulo. His defense cited the “flexibility in the right to choose the domicile [eleitoral]” and claimed that there are professional, political and community links with the state.

He also said that Moro has a political base in São Paulo, received honors in the state and worked in the city for an American consultancy.

The TER-SP is composed of seven judges and is chaired by judge Paulo Galizia.

According to the electoral legislation, “for the purpose of establishing the electoral domicile in the enlistment and transference, the existence of a residential, affective, family, professional, community or other bond that justifies the choice of municipality must be proven”.
