More than twenty residents of Granbury, Texas, have filed a class action lawsuit against mining company Marathon Digital. The plaintiffs complain of deteriorating health conditions due to the “unbearable” noise from ASIC miners.

According to the lawsuit filed in Hood County Court, the nuisance noise generated by Marathon Digital’s mining rig is causing extreme discomfort and irritation to local residents. People living nearby note a noticeable deterioration in their emotional and psychological state.

Some residents also experience physical ailments: fatigue, headaches, memory problems, hearing loss, migraines, tinnitus and high blood pressure. In addition, due to the high electricity consumption of the mining company, people are forced to pay more for electricity.

“Even in our own homes we hear the noise of cryptomines, we feel the vibrations from them. The mining farm prevents us from living in peace and using our property,” the lawsuit states.

According to the plaintiffs, they first heard noise from the mining farm in the spring of 2023. According to Marathon Digital’s July financial report, the company owns 250,000 Bitcoin mining rigs. It is unknown how many there are in Granbury, but the hashrate of the mining farm is 4.3 EH/s.

Rodrigo Cantú, a senior attorney at environmental nonprofit Earthjustice who represents local residents, called on Marathon Digital to immediately reduce its noise pollution or cease operations entirely.

The plaintiffs demanded the court to impose a permanent ban on the mining farm, and also asked for compensation for damage to moral and physical health, including legal costs.

In July, a Texas court acquitted David Fischer, director of the Marathon Digital mining facility in Granbury, ruling that the industrial site did not violate regulatory standards.
