The US Supreme Court is demanding that President Donald Trump’s administration “facilitates” the return of a Maryland man, deported by mistake to El Salvador, but did not determine that the government brings him back to the United States, as Thursday’s decision (10).
The court said the administration should try to return Kilmar Armando Abargo Garcia, a saved citizen deported on March 15. She considered that part of the lower court order, which required the government to “make” its return, was vague and needed an additional review.
The court did not set a deadline for VAGUO GARCIA to return.
“For example, if the judge asks the government about the specific arrangements made with the Salvadoran government and the government invoke the privilege of state secrets, what happens then?” Vladeck added. “Once again, the court is dodging in a context where the government can take advantage of this dodge – a defeat to Trump on the big question, but a defeat to Vugo García in what really matters.”
The three Liberal Judges of the Court did not disagree with the decision, but wrote separately to argue that the Trump Administration’s emergency appeal should have been denied completely.
Judge Sonia Sotomayor has directed the administration to the existing policy of the Executive Power, which states that the federal government should “facilitate the return of a foreigner to the United States if the presence of foreigners is necessary for the continuity of administrative removal procedures.”
Sotomayor’s statement criticized Trump administration for treating the wrong removal as a “supervision error” instead of “accelerating to correct its gross error.”
“The government now requests an order from this Court allowing him to leave Garcia, a husband and father without criminal record, in a saved prison without reason recognized by the law,” she and the other liberal judges said.
“The only argument that the government offers to support its request that the United States courts cannot grant relief since a deportada crosses the border, it is clearly wrong.”
Sotomayor stated that when the case returns to the lower court, the judge must “continue to ensure that the government fulfills its obligations to follow the law.” Among these obligations, she mentioned several protections to due process in immigration status, as well as the United Nations Convention against torture.
