STJ maintains arrest of Monique Medeiros, accused of killing her son Henry Borel

The president of the Superior Court of Justice (STJ), Minister Humberto Martins, denied a request made by the defense of Monique Medeiros to suspend the preventive detention.

With the decision, Monique, who is accused of the death of her son Henry Borel, 4 years old, in March 2021, will remain in prison, along with her ex-boyfriend, the doctor and former councilor Jairo Souza Santos Junior, Dr. Jairinho.

Monique had been under house arrest since the beginning of April, but in June, by order of the Justice, she returned to the Santo Expedito Penal Institute, in the Gericinó Complex, in Bangu, in the West Zone of Rio.

The Court of Justice of Rio de Janeiro (TJ-RJ) re-established the defendant’s preventive detention, reforming the decision of the first degree court that, in April, had replaced the measure with electronic monitoring.

For Minister Humberto Martins, the Rio de Janeiro court duly justified the reestablishment of the prison, so that there is no flagrant illegality that justifies the granting of an injunction on duty.

Martins also pointed out that the request for an injunction is confused with the merits of habeas corpus, which is why a more in-depth analysis of the case must be awaited, to be carried out when the final judgment by the Fifth Panel, where the rapporteur will be Minister João Otávio from Noronha.
