The Superior Court of Justice (STJ) has summarily denied the habeas corpus petition in favor of influencer and lawyer Deolane Bezerra. The decision was issued by Judge Otávio de Almeida Toledo, rapporteur of the case, which is being processed under judicial secrecy. With the denial, the case will not continue in the Superior Court.
Deolane Bezerra remains in preventive detention, a decision upheld by the judge, who highlighted that the case has not yet been judged by the Court of Justice of Pernambuco (TJPE). The denial was based on Summary 691 of the Federal Supreme Court (STF).
The device prevents the STJ from judging habeas corpus when the appeal has not been previously analyzed by a lower court, which, in this case, is the TJPE.
The influencer is being investigated for alleged involvement in illegal gambling and money laundering. She was arrested on Wednesday (4), in Recife, in an operation by the Civil Police of Pernambuco.
Deolane was placed under house arrest last Monday (9), but returned to closed regime the following day for violating precautionary measures imposed by the Court.
She is currently being held in custody at the Buíque Women’s Penal Colony, in the interior of Pernambuco, while investigations continue.
Meet the prison where Deolane is
With more than double its capacity, the Buíque Women’s Penal Colony has adapted cells with more beds. The prison is known for its impeccable cleanliness and strict control over cell phones and drugs. It is in this location, 270km from Recife, that lawyer and influencer Deolane Bezerra will spend her days until she is released or tried.
Arrested again on Tuesday (10), after failing to comply with precautionary measures imposed by the Court, Deolane will be entitled to weekly visits, but may be called upon to reinforce the team that works in the kitchen, which is the responsibility of the inmates. Sunbathing is prolonged, starting in the morning and going until the end of the afternoon.
There are 228 women in prison for 107 vacancies according to the latest report from the National Justice Council obtained by CNN.
The prison has a library, metal detectors, dental offices and a classroom. However, there are reports of a shortage of doctors, especially gynecologists and psychiatrists.
Social programs in areas such as sewing help to provide prospects for prisoners who will have to return to the job market. For some years now, the prison has been run by a woman, Anna Karina Patriota. Under her management, one of the hallmarks is ‘impeccable cleanliness’.
There are, however, reports of a shortage of doctors, such as gynecologists and psychiatrists.
Deolane is in an isolated cell according to the Secretariat of Penitentiary Administration and Resocialization of Pernambuco.
“As this is a high-profile case, Deolane Bezerra is being held in a private cell to ensure her physical integrity. This is a common measure in cases involving public figures, and is intended to protect the inmate from potential threats from other inmates,” the agency reported.
