After the height of the Covid-19 pandemic, the Federal Supreme Court (STF) formed a majority to define the new rules for evictions and evictions.
The Court followed the decision of Minister Luís Roberto Barroso, rapporteur of the action. Earlier this week, the magistrate determined that the Courts of Justice and the Federal Regional Courts must create land conflict commissions to analyze these cases.
Throughout the pandemic, Barroso suspended collective evictions and evictions while the health crisis caused by Covid-19 lasted. The action was filed by Psol in 2020.
In these commissions to be formed, the courts must previously hear representatives of the affected communities.
Removals must be carried out within a reasonable minimum period to remove the population involved.
In addition, it is necessary to direct people in social vulnerability to public shelters. It will also be necessary to ensure the right to housing and it is forbidden to separate members of the same family.
“Although in the current scenario, the full maintenance of the precautionary measure is not justified, I reiterate that the resumption of repossessions must be carried out responsibly, cautiously and with respect for the fundamental rights at stake. Therefore, in consideration of all the interests in dispute, it is necessary to establish a transitional regime for the progressive resumption of repossessions”, defended Minister Barroso in his decision, published on Monday (31).
“The simultaneous execution of thousands of eviction orders, involving thousands of vulnerable families, would generate the risk of social upheaval,” added Barroso.
