STF drops automatic environmental licensing for medium-risk companies

The Federal Supreme Court (STF) decided, unanimously, to prevent the so-called automatic environmental licensing for companies classified as medium-risk activities.

The 10 ministers who voted in this Thursday’s judgment (28) followed the vote of Minister Cármen Lúcia, rapporteur of the action, who defended the imposition of an interpretation to prevent this simplified procedure for granting permits from being applied to environmental licensing. .

For the minister, the approved law (which came from a provisional measure signed by President Jair Bolsonaro) “offends the constitutional norms for the protection of the environment, in particular the principle of environmental precaution”.

The action was presented by the PSB, which questioned the change that, according to the party, provides for the automatic granting, without human analysis, of operating permits and licenses, including environmental ones, for companies classified in medium-risk activity.

In the PSB’s understanding, this change made by the Bolsonaro government would weaken the system for releasing these licenses and make authorization easier, requiring companies only to sign a consent form to carry out the activities.

This is yet another decision by the STF against acts by the Bolsonaro government regarding environmental policy. In the same session this Thursday (28), the ministers decided to overturn decrees that reduced the participation of civil society in the deliberative council of the National Environment Fund, the removal of governors of states in the Legal Amazon from the National Council of the Legal Amazon and the extinction of the Amazon Fund Organizing Committee.
