State of SP is ordered to pay compensation to the daughter of a driver whose photos were published after dying in an accident

The state of São Paulo was condemned by the 12th Chamber of Public Law of the Court of Justice of São Paulo, which maintained the decision of the 2nd Civil Court of São Sebastião, to pay compensation of R$ 20 thousand to the daughter of a truck driver who He died charred in an accident and images of his body were published at the Legal Medical Institute (IML).

The accident that killed the man occurred on November 18, 2019, on Rodovia dos Tamoios, the victim's vehicle was a truck transporting around 20 cubic meters of ethanol and gasoline when it overturned and caught fire.

According to the appeal's rapporteur, judge Edson Ferreira, it is possible to see that they were taken while the body was in state custody.

“The image of a human body consumed by fire is absolutely shocking and likely to hurt anyone's sensitivity, and more intensely that of family members, who will keep it in their memory for a long time, reliving the pain of the tragic loss of their loved one. Therefore, the State’s duty to compensate for the harm caused to the author is undeniable,” wrote the judge.

The compensation decision was unanimous.
