SP: Justice maintains arrest of luxury car driver who killed pedestrians

THE Driver who ran over and killed Cristiano Almeida da Cruz, 38, at dawn last Friday (11) in Guarulhos in the metropolitan region of São Paulo, had the arrest in the act converted into preventive .

According to the São Paulo Court of Justice (TJ-SP), Erik Rodrigo Batista, 38, had a custody hearing on the same day of the accident and remains detained while the inquiry is still underway.

Safety cameras images recorded the moment when the victim appears being brutally hit by the Audi Q3 conducted by Erik, who was traveling at high speed. Cristiano died on the spot.

After being run over, the driver fled without relief, but was located and arrested in the act by the Military Police shortly thereafter, in São Paulo. At the police station, Erik confessed to consuming alcohol before the accident.

According to the police report, he reported that he was in a happy hour and would have ingested about eight 600ml beer bottles.

Despite admitting alcohol consumption, Erik refused to perform the breathalyzer test. The police described in the record that the driver had obvious signs of drunkenness, such as dragged voice, strong ethyl odor and motor difficulties.

The case was registered as a homicide with eventual intent – when the risk of provoking death – as well as drunk driving and omission of relief.
