The Senate Constitution and Justice Committee approved, this Tuesday (6), the bill that prohibits the use of the thesis of “legitimate defense of honor” as an argument for the acquittal of those accused of femicide. The text goes to the House for analysis, if there is no appeal to go through the Senate floor.
The rapporteur of the proposal, Senator Alexandre Silveira (PSD-MG), also included in the project an article that excludes mitigating and penalty reductions related to “strong emotion” in the case of crimes against women.
Silveira also stated that the thesis is “outdated and does not reconcile with the values and rights in force in our Federal Constitution”. “It is a thesis that contributes to the objectification of women. That is, it reinforces the idea that the woman is an object that belongs to her spouse, partner”, she added.
For the author of the bill, Senator Zenaide Maia (PROS-RN), the victim is now identified as responsible for the aggressions suffered and for his own death, while the accused is transformed into a “heroic defender of supposedly legitimate values”. .
According to the 2021 Brazilian Public Security Yearbook, in 2020 alone there were 1,350 femicides and 230,160 cases of bodily harm in the context of domestic and family violence. During this period, 294,440 urgent protective measures were granted by the Courts of Justice.
