The operation of the payment service Samsung Pay in Russia was under the threat of a ban. All because of the Swiss company “Squin SA”, which filed a lawsuit against the South Korean giant for illegal use of technology, namely patent No. 2686003 for online payment using a mobile device. The Moscow Arbitration Court came to the conclusion that Samsung Pay really uses the technologies of the Squin SA patent, therefore it satisfied the claim, which actually prohibits the operation of the payment service on the territory of Russia. According to Yandex.Patent, a patent application from the Swiss company was filed in Russia in December 2013, and Samsung Pay was launched in the country in the summer of 2016. At the moment, it is the third largest payment system in Russia in terms of the number of users after Google Pay and Apple Pay.
At the same time, the court’s decision in theory also prohibits the sale in the Russian Federation of Samsung products that support the Samsung Rau payment system. In other words, the company has no right to sell smartphones, tablets and Galaxy smart watches in Russia. Samsung has three options: appeal the court decision within 30 days, challenge the patent itself, or negotiate with the copyright holder.
Experts believe that Samsung needs to challenge the patent with Rospatent. If, nevertheless, the court decision comes into force, then the company will not need to stop selling its devices in Russia, but only to remove Samsung Rau from the list of pre-installed software. By the way, the operation of Apple Pay and Google Pay services may also be under the threat of a ban, since they use technologies similar to those described in the patent.
