Justice accepted a request from a same-sex couple for paternity leave of 180 days. The right was granted to one of the spouses, Sergeant Valdi Barbosa, from the Military Police of Pernambuco.
The decision was issued by the Court of Justice of Pernambuco in the late afternoon of Wednesday (23).
The couple followed the natural procedure of the legislation and opened an administrative process in the Military Police, which was not approved. The next step was to appeal to the Court of Justice of Pernambuco, which granted paternity leave.
The Military Police of Pernambuco confirmed, in a note, compliance with the decision. Earlier, the sergeant had received a 20-day leave of absence.
Sgt., in an interview with CNN , stated that the main challenges of facing a process of this magnitude lie in the psychological condition and in the domain of anxiety. “”This right is not my right, it is the right of the child. It’s my daughter’s right!
Rafael, husband of the military policeman, told CNN that the decision of the Justice of Pernambuco creates a legal precedent for other homoaffective couples to have this right.
“The importance that I see of our achievement of paternity leave of 180 days is to show families, especially male affective ones, that they can have their children and seek their rights.”, declared Rafael.
