Rio government prohibits app drivers from charging for air conditioning

The government of Rio de Janeiro prohibited app drivers from charging additional fees for the use of air conditioning during races held in the state. The measure was announced by the Consumer Protection Secretariat in this Monday's (8) edition of the State's Official Gazette, and is now in force.

According to the resolution, charging an additional amount is an abusive practice, as it is not provided for in the contract. The text also says that transport applications must now provide clear and precise information regarding the use or not of air conditioning in vehicles in all categories of available services, at the time of contracting.

“In the service categories in which the passenger transport application platform allows the driver to use or not the air conditioning, it must make this option available to the consumer at the time of contracting the service and that the use of the air conditioning will not result in charges additional payments compared to those already contracted”, informs one of the excerpts of the text.

The resolution also establishes that all vehicles must circulate with air conditioning on, regardless of the service category, until transport applications adapt to the new terms.

“The non-use of air conditioning will only be tolerated when this is the passenger’s option,” says the new legislation.

Vehicles whose air conditioning is not working must have their circulation suspended, and will only be allowed to return after adapting the information on the platform or repairing the device. Failure to comply with the new terms may result in sanctions provided for in the Consumer Protection Code (CDC).

A CNN contacted the transport companies via app and is awaiting a position on the new state standard in Rio de Janeiro.
