The Public Ministry of Rio Grande do Sul filed an appeal against the release of the four accused for the 242 deaths in the Kiss nightclub, which had the decision of the Jury Court annulled this Wednesday (3).
“The Public Prosecutor’s Office of the State of Rio Grande do Sul requests the granting of provision, pursuant to paragraphs 8 and 9 of art. 4 of Law 8,437/1992, in order to suspend the decision of the Court of Justice of the State of Rio Grande do Sul, granting freedom to the accused, in order to allow the defendants Elissandro Callegaro Spohr, Mauro Londero Hoffmann, Marcelo de Jesus dos Santos and Luciano Augusto Bonilha Leão, continue to fulfill the sovereign condemnation issued [lavrada] by the Jury Court, in accordance with the determination of the Federal Supreme Court”, requested the Attorney General of Justice, Marcelo Lemos Dornelles.
This Wednesday’s trial analyzed appeals filed by the defenses of the four convicted of the nightclub fire. Two of the accused, Santos and Leão, who were imprisoned in São Vicente do Sul, were released on Wednesday night. Spohr and Hoffmann had not yet left prison until the DA’s appeal.
For the judges who voted in favor of the annulment, the defenses’ allegations justify the suspension of the trial. The magistrates accepted the understanding that, among other points, the selection of the jurors did not take place within the period established by law.
