The physical education teacher, Clayton Ferreira Gomes dos Santos, aged 40, who had been arrested last Tuesday (16) on charges of robbery, was released this Thursday afternoon (18).
The professor's defense lawyer, Danilo Cavalcanti Reis Claudino, had filed a habeas corpus petition, asking for the professor's freedom yesterday afternoon (17), which was granted by the judge of the Court of Justice, Roberto Porto.
In the document, the lawyer presented the teacher's time sheet, which showed that he was teaching on the date of the crime with which he was accused. The crime would have been committed on October 31, 2023, in the city of Iguape, on the coast of São Paulo.
The point, signed by the teacher, supposedly recognized by a photo shown to the victim during the civil police investigation into the case, is from a school in the Saúde neighborhood, South Zone of São Paulo, 200 kilometers from the location.
Upon leaving the 26th Police District, where he was detained for the last two days, Santos said that he was arrested when he went to the police station to be interviewed, because in his opinion, he owed nothing.
“Spontaneously, I got there (at the police station). And then when I really realized that I saw that there were more than six police officers around me, right? Then I could see what was actually happening, right? Then he said he had a warrant for my arrest, right?
The lawyer explained that the teacher had been the victim of a theft and that he believed he would go to the police station to talk about the matter. “He came believing it was something, because he reported an incident in which he was the victim of theft on a previous date. He came thinking that was it and here I was surprised by this temporary arrest warrant,” he explained.
The professor's defense concluded by stating that it understands that there is no way to determine whether the arrest was due to racism, but claims that the arrest based on photographic recognition must be corroborated by other pieces of evidence.
The case continues to be investigated by the Iguape Police Station.
