Police concludes inquiry against students who moved in young transplanted

The Civil Police concluded last Wednesday (16) investigations into the case involving two medical students who published a video on a social network to mock the young Vitória Chaves da Silva, who died in February this year in Sao Paulo after passing four transplants. The inquiry was referred to justice.

According to the Secretariat of Public Security, as it is a crime of private criminal action, the victim’s mother was advised to provide criminal complaint before the court, so that appropriate measures can continue.

The case gained repercussion after the young woman of the young woman formalizing a complaint against the students, who requested a retraction. The Civil Police opened an inquiry by injury.

In a video after the case was viralized, Thaís Caldeiras Soares and Gabrielli Farias de Souza explained that the content published on social networks had no intention of exposing or mocking the patient.

“We are coming to public to tell the family that we really feel a lot for the loss, and we make it clear that the intention of the video was never to expose. The only intention was to show surprise by a very rare case that we become aware of an environment of medical practice and learning,” they said.

In the video, the students also said they did not have access to the patient’s medical record and that, at no time did they disclose images related to her.

“In addition, it is important to make it clear that we did not know the patient’s full name. The video was made based on general information about the case and we never intended to invade anyone’s privacy,” they added.

In the original video, the students talked about the case of the patient Vitória. “So, I don’t know. Is this girl thinking there are seven lives? I don’t know, ”says one of the students in the recording. The publication was deleted from social networks on Tuesday (8).

The video was recorded days before the patient’s death. She was hospitalized at the Heart Institute (Incor) of the Clinical Hospital of the University of São Paulo School of Medicine. The cause of the young woman’s death would have been a septic shock and chronic renal failure.

Crimes

THE CNNlawyer Henrique Cataldi assessed that, in addition to the crime of injury, medical students can respond for defamation and psychological violence.

See the penalties:

  • Injury: arrest from one to six months and fine
  • Defamation: arrest from three months to one year, in addition to a fine
  • Psychological violence against women: arrest from six months to two years and fine

The expert also points out that the legislation provides for increased penalty when “the crime against honor is committed by facilitating the dissemination of the offense, as in the present case, in which the video was widely shared via social network [TikTok]expanding the scope of damage and the improper exposure of the victim ”.

“Parallel to criminal liability, conduct can also have consequences in the civil sphere, especially regarding the obligation to compensate for moral damages caused to the victim and his family,” explains Cataldi.

Also according to the lawyer, Gabrielli and Thaís will also be able to suffer academic sanctions according to the Internal Regulations of the institutions ranging from warnings to the dismissal of the course.

According to a Vitória publication on a social network, the first transplant took place in 2005. The second happened 11 years later, in 2016, due to disease in the coronary veins. The third, and last transplant, took place in 2024.
