A message of cooperation of the political forces in the field of Justice was addressed by the competent minister, K. Tsiaras, citing data on the lost cases from the Corfu Prosecutor’s Office.
Answering a relevant topical question by PASOK-Movement for Change MP Haris Kastanidis, Mr. Tsiaras said that the investigation, two years later, has not yet been completed and that the extent of the damage from the former prosecutor’s actions can not be determined.
“The titanic work carried out in the services involved, not only to find the lost cases, but also to find out how many cases have been altered, is in progress and I hope it will be completed as soon as possible,” said Mr. Tsiaras, giving the following information. :
– There are 969 files and lawsuits that were found and confiscated outside the store of the Corfu Prosecutor’s Office. Of the 153 cases that were deemed to have been definitively returned, it is not possible to answer how many crimes and how many misdemeanors, as there is a lack of evidence, the evaluation of which would result in the further legal characterization of the criminal act.
– The data entered in the electronic system of the department of these lawsuits, were minimal to incomplete, and did not lead to a safe conclusion for the legal characterization of the crime
– For these 153 cases, from the control of the electronic system, only 9 entries emerge, which concern financial crimes against the state. However, out of the total of 153 lawsuits, there are 93 registrations of lawsuits, without the registration of a possible offense, which may include other financial crimes against the public.
– For the statute-barred cases, the information we have is that, the specific former prosecutor, until March 2020, returned to the prosecutor’s office 88 criminal-misdemeanor cases, which had been charged to her, and were barred in her hands. Furthermore, the electronic system results in 70 criminal cases that were returned statute-barred, and 19 that were never returned, and were also statute-barred.
– Of the 969 confiscated files, only 26 were further processed, because the others were deemed statute-barred. Therefore, the other limitations amount to 943
As Mr. Tsiaras said (these cases) are too many. This is the reality and we must say it publicly, said the Minister of Justice, while emphasizing that at the same time many other judicial officials have emerged who adequately contribute to the restoration of the prestige of Justice. “I declare that I have confidence in Justice and the officials “and I try with reformist institutional interventions, to provide all the necessary procedural tools so that the Justice, internally, can take the necessary steps so that similar situations do not happen again in the future,” said Mr. Tsiaras. He even mentioned, as an example, the recently adopted Code of the Organization of Courts.
For his part, Mr. Kastanidis said that he understands from the answer of the minister that, “the effort will be joint” to achieve the protection of the public interest, but also the prestige of Justice.
He also pointed out the need for the people to know, both about the type of crimes of the lost cases (what are the crimes and what are the misdemeanors), as well as about who the perpetrators and the victims are. “It must be discussed whether critical cases have become statute-barred. The type of cases must be known. (Who they are) those who benefited and harmed. They must be made known, because Justice is given in the name of the people,” said the PASOK-Movement MP Change.
Finally, Mr. Kastanidis stressed the need to ask the question “whether a former prosecutor suddenly decided on her own (these acts) or is there something else behind the curtains …”.
“In 2019, the then appellate prosecutor who started the investigation, suffered an unfavorable transfer [..] The judges who are involved are worthy to handle the project but they will need the support of their superiors as well “, said Mr. Kastanidis.
