Michelle Salazar, a Mexican businesswoman, moved with her husband, Sam Napier, to the United Kingdom, where she started a business selling tacos and her business was soon successful. However, an unexpected lawsuit changed everything.
The problem arose because a company from that country says that they should not use the word “Taquería” in other places, since that word is in their commercial name: Worldwide Taquería.
According to the medium eater londonBritish entrepreneurs Trent Alexander Ward and Daniele Benatoff, owners of Worldwide Taquería, filed a lawsuit pointing to trademark infringements committed by Michelle and her husband by calling their taco business: Sonora Taquería.
The plaintiffs alleged that they have two locations, one in Notting Hill and the other in Exmouth Market, and have the registration of the “Taquería” brand. In addition, they gave Michelle a series of possibilities to reach an agreement and they hope that these will be addressed next Wednesday, September 21, before the courts.
As with all UK trade mark registrations, the provisions of the Trade Marks Act give the owner the exclusive right of the trade mark and those are infringed when the mark is used in the UK by another company without the consent of the owner.
As such, use of ‘Taqueria’ by Sonora Taqueria Ltd without the consent of Worldwide Taqueria Ltd constitutes trademark infringement.
Michelle would probably end up changing the name of her place to avoid more problems. However, her clients will continue to come to her, not because of the name of her business, but because of her exquisite flavor.
