MP from the TCU asks Bolsonaro to be warned about fiscal and electoral risks of the PEC dos Vantagens

The Public Ministry at the Federal Audit Court (MP-TCU) asked, this Wednesday (13), that the government and the Electoral Attorney General’s Office be alerted regarding the constitutionality of the Benefits PEC, which designates more than R$ 41 billion for aid to truck drivers, taxi drivers and low-income families.

The representation, signed by the deputy attorney general of the MP-TCU, Lucas Rocha Furtado, argues, in a proposal, “blatantly unconstitutional”.

Furtado requested that the President of the Republic, Jair Bolsonaro, be alerted, as a matter of urgency, of the risks of disrespecting the rules of fiscal responsibility and the electoral consequences. “(…) Possibility of challenging an elective mandate and opening a judicial investigation to investigate improper use, deviation or abuse of economic power or the power of authority”.

The sub-attorney also asks that the compatibility of management acts be verified if they are in accordance with the PEC of the spending ceiling and the Fiscal Responsibility Law (LRF) and, if perchance, it may be framed in the crime of abuse of political and economic power. .

Directed to the president of the Court of Auditors, Minister Ana Arraes, the document also states that the PEC “affronts the principle of the precedence of the electoral law with the use of a state of emergency artificially created to justify the use of extraordinary resources”.

Finally, the prosecutor also requested that the representation be forwarded to the Electoral Attorney General’s Office and to the electoral committees of the pre-candidates for the presidency of the Republic, and that precautionary measures be adopted.

The rapporteur of the new process is Minister Aroldo Cedraz, who will analyze, together with the audit of the Court of Auditors, whether the information presented by the MP/TCU is correct.
