Members of the Ministry of Indigenous Peoples are confident that President Luiz Inácio Lula da Silva (PT) should veto the article of the law that establishes the time frame.
The text was approved by Congress on September 27th, just a week after the Federal Supreme Court (STF) formed a majority against the thesis.
Last week, the legal consultancy of the Ministry of Indigenous Peoples and the Federal Attorney General’s Office delivered a 19-page opinion in which they point out the bill’s unconstitutionalities point by point and call for a total veto.
The Federal Public Ministry expressed its support for the full veto of the text and stated that the proposal is unconstitutional.
According to minister Sonia Guajajara’s interlocutors, the signal that the ministry received is that the president will maintain what was defined by the STF.
The government is also evaluating the possibility of partially vetoing the text and trying to “save” some articles to avoid political wear and tear with parliamentarians or even a possible overturn of the veto.
The deadline for the president to veto or sanction the project expires tomorrow. The expectation is that the president’s decision will be published in an extra edition of the Official Gazette this Friday.
