The strike on train and subway lines this Tuesday (3) will not have a free turnstile. The decision is from the Labor Court of the 2nd Region (TRT-2).
Judge Celso Ricardo Peel Furtado de Oliveira, from TRT-2, prohibited the release of the turnstiles because “the collection for the provision of public services does not fall within the list of rights for exercising the right to strike, causing, if granted, a serious offense to the economic order.” The request for a free turnstile had been made by the Metro Workers’ Union.
Another decision by TRT-2 also vetoed the free turnstile proposed by the Railway Workers Union. Judge Raquel Gabbai de Oliveira accepted the arguments of Companhia Paulista de Trens Metropolitanos (CPTM), which said that free turnstiles could cause chaos and risk of accidents.
If the order is not complied with, each union will be fined R$500,000.
In the injunction granted by TRT-2, it is also established that CPTM workers maintain 100% of the workforce during peak hours (between 4am and 10am/4pm and 9pm) and 80% during other periods. The decision is valid for train drivers, station officers, security guards, maintenance and operations.
In the Metro, according to the judge’s determination, 100% of the fleet must be secured between 6am and 9am and from 4pm to 7pm and 80% in other periods. A fine of R$500,000 was defined if there is non-compliance.
Which lines should be affected by the strike?
The lines that will be affected by the strike are the following:
- Line 1–Blue (Metro)
- Line 2–Green (Metro)
- Line 3–Red (Metro)
- Line 15–Silver (Metro)
- Line 7–Rubi (CPTM)
- Line 10–Turquoise (CPTM)
- Line 11–Coral (CPTM)
- Line 12–Sapphire (CPTM)
- Line 13–Jade (CPTM)
Lines operated by the private sector will not be affected.
Lines 8-Diamante (train), 9–Esmeralda (train) and 5–Lilac (subway) are managed by ViaMobilidade. Line 4–Yellow (metro) is the responsibility of ViaQuatro.
Due to the strike, São Paulo City Hall suspended vehicle rotation on Tuesday (3).
