The Court of Justice of São Paulo (TJSP) sentenced this Wednesday (10) Janderson de Sousa Silva to 27 years and 10 months in prison for having assaulted a homeless resident to death. The crime took place in 2023, and was motivated by a money debt.
According to the São Paulo Public Ministry (MPSP), Janderson had lent R$50 to the victim Miguel Camilo de Souza Neto, who was homeless. On February 1, 2023, both met on Avenida Orestes Quércia, in São Joaquim da Barra (SP), when the criminal demanded the return of the money.
During the argument, the convict threw a series of punches and kicks at the victim's head even when Miguel was already lying on the floor, offering no resistance.
Even after the military police arrived at the scene, Janderson continued to attack Miguel and resisted the agents' approach until they managed to restrain and handcuff him. Still, the victim did not survive his injuries.
The action that resulted in the conviction was filed by prosecutor Nathália Piola, and took Janderson to the jury plenary, the judiciary body responsible for judging intentional (intentional) crimes against life. At the time of the trial, the prosecutor Felipe Ribeiro Santa Fé acted.
In the sentencing decision obtained by the CNN judge Augusto Rachid Bittencourt stated that Janderson is extremely aggressive and demonstrates “evident emotional insensitivity and coldness, indicating a tainted personality”.
The sentence also reported that Janderson spontaneously confessed to committing the crime. When asked about the case, he replied that “I kicked the shit out of him!”
Thus, the TJSP convicted Janderson of qualified homicide for a futile and somewhat cruel reason, and for having resisted the approach of the police officers. Furthermore, it was considered that Janderson is a repeat offender and has three previous convictions for robbery and bodily harm.
A CNN , defense lawyer Lucas Magalhães de Oliveira stated that he intends to appeal the sentence. According to him, the penalties imposed were exacerbated and were not adequately substantiated.
