A retired judge was reported by the Public Prosecution Service of São Paulo for the use of false document and ideological falsehood after using a fictional name. According to the investigations, the magistrate, whose real name is José Eduardo Franco dos Reis, adopted the identity of Edward Albert Lancelot Dodd Canterbury Caterham Wickfield for about 40 years.
In an interview with CNN the lawyer Alberto Toron responsible for the defense of the judge, argues that the change of name is related to a “existential, familiar and sad question”, whose details will be revealed to the judge responsible for the case, which runs in confidentiality.
Defense claims absence of improper advantage
Toron argues that although the conduct could be criticized or disapproved, his client has not committed a crime. The lawyer argues that the crime of ideological falsehood presupposes obtaining illicit advantage which, according to him, did not occur in this case.
“There was no improper advantage that he had obtained with this exchange of names,” said Toron.
Earlier this month, the president of the TJ-SP determined the suspension of retirement payment of the magistrate. The Court reported that there is a matter pending judicial assessment and that it cannot comment on the effects of a possible conviction.
However, the defense questions this decision, claiming that the judge effectively worked, issued sentences and orders, being considered an exemplary magistrate, without disciplinary absences in his history.
Toron argues that, regardless of the name used, the magistrate met the objective and subjective requirements for retirement, having contributed regularly. He compares the situation to a service provided, where the provider’s name would be irrelevant in the face of the work done.
With the fictional name, José Eduardo studied law at University of São Paulo (USP) In the 1980s and, years later, he held a competition and joined the São Paulo judiciary.
The fictional personality would have been created in September 1980, when Reis was able to take a RG with the fake name. In the document, he was reported that he was the son of Richard Lancelot Canterbury Caterham Wickfield and Anna Marie Dubois Vincent Wickfield, a family of British origin.
