“Intent has never been to expose,” students say who mocked transplanted

After the repercussion of a video published in Tiktok, medical students Gabrielli Farias de Souza and Thaís Caldeira Soares Foffano manifested themselves on accusations of mocking a transplanted patient .

The case involved 26 -year -old Vitória Chaves da Silva, who died in February 2025 after fighting a serious congenital heart disease, having undergone three heart and kidney transplants.

In a video recorded by themGabrielli and Thaís explained that the content published on social networks had no intention of exposing or mocking the patient.

The students stressed that they deeply lamented the young woman’s death and felt sad for the loss of her family. “We are coming to public to tell the family that we really feel a lot for the loss, and we make it clear that the intention of the video was never to expose. The only intention was to show surprise by a very rare case that we become aware of an environment of medical practice and learning,” they said.

In the video, the students also said they did not have access to the patient’s medical record and that, at no time did they disclose images related to her. “In addition, it is important to make it clear that we did not know the patient’s full name. The video was made based on general information about the case and we never intended to invade anyone’s privacy,” they added.

Gabrielli and Thaís, who study at Anhembi Morumbi and Faseh universities, said they are taking the necessary measures to clarify the facts in the best possible way.

Investigation

THE Video that repercussions was recorded in February days before the death of Vitória, at the Heart Institute (Incor) of the University of São Paulo Hospital das Clínicas (FMUSP), where the young woman was hospitalized. The cause of the young woman’s death would have been a septic shock and chronic renal failure.

The video publication generated revolt on social networks and led Vitória’s family to denounce the students. According to the São Paulo Public Security Secretariat, the case is investigated as an injury through a police inquiry initiated at the 14th Police District of Pinheiros.

THE CNN lawyer Henrique Cataldi, a postgraduate degree in Law and Criminal Procedure from the Damásio College, assessed that in addition to the crime of injury, provided for in Article 140 of the Penal Code, medical students can respond for defamation and psychological violence.

  • Psychological violence against women: imprisonment from six months to two years and fine

The expert also points out that Article 141 of the Penal Code provides for an increase in the penalty when “the crime against honor is committed by facilitating the dissemination of the offense, as in the present case, where the video was widely shared via social network (Tiktok), expanding the range of damage and improper exposure of the victim”.

“Parallel to criminal liability, conduct can also have consequences in the civil sphere, especially regarding the obligation to compensate for moral damages caused to the victim and his family,” explains Cataldi.

Also according to the lawyer, Gabrielli and Thaís will also be able to suffer academic sanctions according to the Internal Regulations of the institutions ranging from warnings to the dismissal of the course.

Colleges response

Gabrielli Farias de Souza and Thaís Caldeira Soares Foffano, who appear in the images, study Medicine at Anhembi Morumbi University in São Paulo, and at the Faculty of Human Health and Ecology (phaseh) in Minas Gerais.
