Henry case: hospital says boy was already dead when he arrived at the unit

The boy Henry Borel would have arrived dead at the hospital on March 8, 2021, according to a letter sent by Rede D’Or to the Court of Justice of Rio de Janeiro. The document is a complement to what was already informed at the beginning of the process that investigates the death of the 4-year-old boy.

Jairo’s lawyers argue that Henry’s death was caused by the resuscitation maneuvers performed during hospital care. At the request of the Justice, which accepted the defense’s request for clarification, the hospital denied the accusations and stated that the boy was already dead when he was admitted to the health unit.

“It is worth mentioning that the child, at the time of his arrival, already presented, on physical examination, signs of stiffness in the jaw and fixed mydriatic pupils, a condition that indicated the presence of cardiorespiratory arrest for some time”, highlighted the medical opinion attached to the craft.

In a note to CNN , Jairo Souza Santos Junior’s lawyer, Cláudio Dalledone, said that hospital documents prove that Henry arrived at the hospital alive. In addition, he highlighted that he will prove Jairinho’s innocence.

“More than one x-ray was done, they tried to intubate the boy, take the vein in Henry’s hand, arms, leg and neck, hence the bruises. No hospital in the world does x-rays, intubates a dead child. The truth is that Henry Borel entered Barra D’or alive and left without life. What is the Barra D’or hospital trying to hide?”, said the lawyer.

In a statement, the hospital reported that it has been actively collaborating with Justice and that all the documentation requested by the authorities has been delivered. Rede D’or emphasizes that it is not part of the process, it is only cited for having helped the boy.

The letter highlights that it is not possible that Henry had died as a result of the strategies adopted by the medical team, who tried to perform resuscitation procedures on the boy.

“In view of the above, one cannot speak of any relationship between the death of Henry Borel, found in the necroscopic examination to have been caused by hemorrhage resulting from hepatic rupture, and the conduct adopted in the premises of the Barra D’Or Hospital, since there were already obvious signs that the child was already dead when he was attended to”, says the document.

In addition to clarifications from the hospital, Judge Elizabeth Machado Louro accepted other requests from Jairo’s defense in the defendant’s last statement, on June 13. She asked for the seizure of the hospital’s cameras, delivery of the second x-ray performed on Henry, on-call schedule, certificate from health professionals and checking the time of the cameras in the elevator of the building where Henry lived.

At the time, the former councilor stated, in testimony, that the boy would have arrived “without a scratch” at the health unit.

According to the TJ, there is still no date set by the Court of Justice to decide whether Jairo and Monique will go to the popular jury or not. However, CNN learned that the judge will rule on the indictment in August. After the documentation phase, the deadline for final written arguments will be opened.

The Public Ministry of Rio de Janeiro has three days to manifest itself. Then the prosecution assistance will also have three calendar days. Subsequently, the defense of Jairinho will have the same period to comment and, finally, the defense of Monique Medeiros, Henry’s mother. Deadlines are sequential.
