Harvey Weinstein will be tried on charges of rape and sexual assault on Manhattan on Tuesday (15), a year after a state court of annulment of the 2020 cinema tycoon.
Weinstein, 73, faces an accusation of rape and two accusations of criminal sexual act in the trial with jury, chaired by Judge Curtis Farber of the Higher Court. Weinstein, co-founder of Hollywood’s Miramax Studio and former Producer, declared himself innocent and denied having assaulted someone or practiced non-consensual sex.
His conviction was a crucial moment for the #Metoo movement, which encouraged women to denounce allegations of sexual misconduct by powerful men in the media, politics, and other spheres.
The trial, which will start with the jury national team on Tuesday (15), should last about six weeks. Farber and lawyers from both parties must interrogate and select 12 judges among a group of Manhattan residents. The verdict must be unanimous to condemn.
In 2020, a jury considered Weinstein guilty of rape and sexual assault, and he was sentenced to 23 years in prison. A state court of appeals annulled the conviction in April 2024 and ordered a new trial, concluding that women who accused Weinstein of aggressions that were not part of the accusations against him should not have been allowed to testify.
Prosecutors of Manhattan’s public prosecutor Alvin Bragg accused Weinstein of sexually assaulting former production assistant Miriam Haley in 2006 and raping aspiring actress Jessica Mann in 2013, accusations for which he was convicted in the first trial. In the new trial, Weinstein also faces a new accusation of allegedly assaulting an unidentified woman in Manhattan in 2006.
During the first trial, the prosecutors portrayed Weinstein as a series predator who manipulated women with career advances in Hollywood, attracted them to hotel rooms or private apartments and then dominated and attacked them.
Werstein is likely to spend the rest of his life in prison, even if he is acquitted in the new trial in New York, as he was sentenced to 16 years in prison after being sentenced separately for rape in California. He has not yet begun to serve the sentence and remains stuck in New York since his conviction was annulled.
In September 2024, Weinstein was rushed to a hospital and underwent emergency cardiac surgery. The episode was one of several scares he faced while being detained in the prison of Rikers Island in New York, where his representatives said he was receiving inappropriate medical care.
More than 100 women, including famous actresses, accused Weinstein with misconduct, and the allegations against him were the focus of #Metoo. He denied the accusations and stated that all his sexual meetings were consensual.
Weinstein’s film studio was bankrupt in March 2018 after the original accusations of sexual misconduct.
