The Federal Justice in Sergipe authorized this Wednesday (22) the NGO Save to act legally in the manufacture of cannabis-based medicines. Judge Ronnivon de Aragão authorized “the cultivation, handling, preparation, production, storage, transport, dispensation and research of cannabis sativa for exclusively medicinal purposes”.
“I emphasize that, at least for the time being, the importation of cannabis sativa is not being authorized here, given that a measure of this nature involves several bodies of Public Administration and airport structure and surveillance, and it is prudent, at this moment, to restrict authorization” , explained the magistrate.
The Federal Court also entrusted the National Health Surveillance Agency (Anvisa) with overseeing the NGO. Within 60 days, the body must present an action plan “setting in a clear, objective and exhaustive way, the criteria for inspection of the author Association and for the control of its activities, in order to maintain a regular standard of production, both in terms of concerns the quality of the products in relation to the quantity manufactured, the transport of the plants between their place of cultivation and processing”.
Anvisa is also responsible for adopting a routine of periodic inspections, “making a comparison between the Association’s production capacity and what is, in fact, being produced by it, to avoid excesses”, determined the judge.
The request for urgent relief was made by the Associação Brasileira de Apoio ao Cultiva e Pesquisa de Cannabis Medicinal (ONG Save), which is a non-profit association that supports cultivation and research, with 200 members.
In the petition, lawyer Paulo Thiessen declared that the situation is “the right to health and social care of the highest humanitarian degree in favor of both the current associates of the plaintiff, and future ones, with diseases whose control or not is possible without the use of of cannabis-based products”.
“All associations in Brazil can only supply the oil. We asked that not only that be authorized, but also the flowers, which is the part of the cannabis that is used, edibles, and also extracts. It is much broader in the relationship between doctor and patient. It is something new and unheard of”, declared the NGO’s lawyer to CNN .
