Cyprus: He took his ex to court to return the single stone to him after their marriage was annulled

A curious case was heard in the District Court Nicosiain Cyprus. A man requested, through a lawsuit he filed, his return solitaire diamond ring which he gave to his partner when he proposed to her.

According to the woman’s law firm: “The Plaintiff me treatment who filed in the District Court of Nicosia deserved the return of the one-stone diamond ring that he gave to the Defendant in exchange for a promise of marriage, as a result of the breach of the promise of marriage by the latter and, severably, the award in favor of compensation in the amount of €2,500, which is the market value of the ring ».

The District Court of Nicosia dismissed the action.

The decision of the Court, according to the website sigmalive.com:

It follows from the provisions of Articles 2 and 26 A of Chapter 149 that, as a result of legislative regulation, a contract concerning property, which is given by one future spouse to the other, in exchange for the consummation of marriage, is invalid.

The fact that the Plaintiff’s marriage proposal and the ring were accepted by the Defendant cannot be said to have created an obligation to marry between them in exchange for the ring given.

The ring cannot be said to have been given to the Defendant as a gift subject to any condition or stipulation and therefore the Plaintiff’s severance claim based on the principles of unjust enrichment cannot succeed either.
