CVM files lawsuits against Petrobras after president’s resignation

The Securities and Exchange Commission (CVM) opened on Monday (20) two lawsuits linked to the resignation of the CEO of Petrobras , José Mauro Coelho according to information from the municipality.

Coelho resigned from office this morning, after protests by President Jair Bolsonaro and parliamentarians against a new readjustment in the prices of fuels last Friday (17).

A first process will investigate news that anticipated the resignation. The announcement came after the newspaper O Globo earlier reported that members of Petrobras’ board of directors who spoke with Coelho over the weekend reported the executive’s willingness to resign.

Before the company officially manifested itself, business with Petrobras shares came to be suspended in the B3 .

After Coelho’s departure, the state-owned company informed that Fernando Assumpção Borges will assume the position of interim president until a new nominee is elected to the position.

The second process will investigate a “suspicious movement” involving the state-owned company’s actions. Asked whether the investigation may involve any accusation of “insider trading”, the CVM did not manifest.

The municipality told the CNN that “follows up and analyzes information and transactions involving publicly-held companies and the capital market, taking appropriate measures, whenever necessary”, but that “does not comment on specific cases”.

The administrative proceedings opened by the CVM, under numbers 19957.006861/2022-44 and 19957.006614/2022-48, may become a formal investigation, depending on the conclusions reached after analysis by the monitoring management of the autarchy’s companies, as is customary in these cases.

Coelho was fired a month ago, but the process of vetting the candidate nominated to be his replacement, Caio Paes de Andrade , has not yet started. In addition to leaving the presidency of the state-owned company, he also resigned as a member of the Board, as disclosed by Petrobras.

The resignation took place a few days after Petrobras announced a new readjustment in gasoline and diesel prices, which generated Criticism of President Jair Bolsonaro and the president of the Chamber, Arthur Lira.

The successive rises in fuel prices led the government to seek measures to reduce the price charged at pumps. Last week, the bill that established a 17% ceiling on ICMS was approved by the Chamber of Deputies.

With the new diesel price readjustment, the federal government discusses including in the Fuels PEC a kind of aid for drivers and truck drivers.

Also this Monday, the company informed that it became aware of a letter from one of its directors, Francisco Petros, with proposals on the company’s pricing policy. According to the state-owned company, “the proposals are a personal initiative of Petros and were not discussed internally”.

Petros, who represents minority shareholders, would have defended a fuel price freeze for 45 days in addition to the formation of a working group to discuss a new formula for readjustments.
