Criminals in Rio could be accused of crimes against the State, lawyers say

The criminals who set fire to 35 buses, trains and trucks in Rio de Janeiro could be considered a crime against the State and an attack on the democratic rule of law, explain lawyers consulted by CNN .

The criminal classification would be similar to that applied to those convicted of the criminal acts of January 8, as it was a reaction to a constituted power – in this case, an action by the Civil Police of Rio de Janeiro when trying to arrest a militia member.

The crime, therefore, would fit into the new legislation on the subject, with a punishment of 8 to 15 years in prison — much more severe than an act of vandalism.

In a press conference, Governor Claudio Castro (PL) classified the attacks as “terrorist”, but Brazilian legislation defines terrorism only as attacks based on religious prejudice, race, color or ethnicity.
