The Rio de Janeiro Court accepted the Public Ministry’s complaint against two partners and four employees of the PCS Saleme laboratory, involved in the case of infection of six transplant patients with the HIV virus.
According to the Rio de Janeiro judiciary, the six will face criminal association, serious bodily injury and ideological falsehood. An employee will also be charged with document forgery, after defrauding a biomedical diploma.
The judge also decided to prevent the defendants from being detained, citing “the existence of evidence of the materiality of the crime and sufficient evidence of authorship”.
He highlighted the seriousness of the acts carried out, which could compromise public order, criminal investigation and the application of criminal law, in addition to putting the credibility of the transplant system and public health at risk.
The defendants’ mode of operation, which allegedly falsified medical reports and reduced the quality control of exams to cut costs, was considered dangerous and harmful to society.
Of the six defendants, only Matheus Sales Teixeira Bandoli Vieira is free. The laboratory partner even gave a statement in the Consumer Police investigation, but was free.
In a statement, the defense of the PCS Lab Saleme partners considered the request for the arrest of Matheus Vieira, who has voluntarily collaborated with the investigations, to be arbitrary.
According to the lawyers, HemoRio carried out a preliminary analysis of the 286 blood samples retested, showing a negative result for HIV in all of them, confirming that the two incorrect reports were isolated episodes and attributed to human error.
The defense also states that patients infected after transplants will receive support, while the laboratory validates compensatory measures for them and their families with the authorities.
