A US court has decided to file yet another lawsuit filed by the man portrayed naked as a baby on the cover of Nirvana’s 1991 album Nevermind. He had claimed that this depiction was child pornography.
In a ruling Friday, US District Judge Fernando Olguin of Los Angeles said Spencer Elden had waited too long to claim Nirvana sexually exploited him, having filed the lawsuit more than 10 years later. to know about the cover.

The Nevermind cover features a photo taken by Weddle in 1991 at the Pasadena Aquatic Center in California, which showed a baby swimming naked towards a dollar bill pierced with a hook.
Elden was interviewed in 2003, at age 12, by Rolling Stone magazine about the photo, when he stated that he would “probably make some money out of it”. As an adult, in 2016, he recreated the image with “Nevermind” tattooed on his chest.
However, he claimed in his lawsuit, which began in August 2021, that the problem fell under the statute of limitations because his injuries, including emotional distress, loss of earning capacity, and “loss of enjoyment of life” continued into his age. adult.
The judge rejected that argument, noting that it would allow Elden to sue Nirvana as many times as he wanted.
“In short, the plaintiff does not allege that he knew of a violation that occurred when he was a minor or an injury that forms the basis of the claim within ten years of the filing of this action,” Olguin wrote.
Elden has filed three versions of his complaint, but Olguin’s decision prevents him from filing a fourth.
