The Municipality Attorney General (PGM) of Porto Alegre estimates that if convicted in the collective action filed by the Public Prosecution Service (MP), the capital of Rio Grande do Sul would have to be costing up to R $ 4.7 billion. According to PGM, the amount corresponds to almost 40% of the municipality’s annual budget.
The possible cost to public coffers was calculated from the average of the values arbitrated by the judiciary in such actions and the extension of the flood stain, which covers 160,000 people.
Last week, the court responded to the prosecutor’s offices and suspended the processing of individual actions with claims related to the flood of 2024. The MP filed a collective action that asks the municipality of Porto Alegre to be held responsible for moral and material damages and compensate the affected people. In addition, it wants the payment of R $ 50 million as collective moral damage – amount that must be destined to a fund and used to promote increased resilience in the city.
For the Public Prosecution Service, the municipality committed omissions that resulted in failures in flood protection systems.
On the other hand, according to the municipal attorney general, Jhonny Prado, for the configuration of administrative omission, proof of non-compliance with a legal duty to act. “If there was an omission in the case of the flood of 2024 – which does not seem to be the case, given that it is an extraordinary and inevitable situation that reached 95% of the municipalities of the State – the duty to act specific was the Union, which is responsible for protection against floods and climate catastrophes, according to the Federal Constitution.”
The state of Rio Grande do Sul and the Union are not defendants in the action. In the MP’s understanding, the Full Protection System is administered only by the Municipality, without the responsibility of other federative entities.
