CNJ fixes compulsory retirement penalty for judge who offended guard on beach in Santos

The plenary of the National Council of Justice (CNJ) decided, in a vote this Tuesday (22), to set a mandatory retirement sentence for Judge Eduardo Siqueira, of the São Paulo Court of Justice (TJ-SP), for calling him “illiterate”. ” Santos (SP) municipal guard Cícero Hilário, who fined him for walking without a mask, in 2020.

A survey sent to the CNJ by the Court of Justice of São Paulo indicated that the judge was the target of 42 disciplinary procedures in the court in more than 15 years. Most cases were dismissed, and none resulted in serious punishment. The oldest dates from 1987.

The rapporteur, counselor Jane Granzoto, stated that there was a decree that should have been complied with. “The magistrate adopted behavior incompatible with his functions. He showed influence and tore up the ticket,” she said.

The counselor also highlighted that the witnesses corroborated the conduct of the magistrate. “Of this set, there was a previous action that used the position of judge to belittle municipal guards”, she pointed out.

In July of this year, the Special Body of the Court of Justice of São Paulo (TJ-SP) applied the availability penalty against the magistrate, who was removed from office with proportional salary payments.
