Charity bill, here are the rules of the Ferragni decree

The Council of Ministers has given the green light to the charity bill. The bill introduces rules and sanctions that aim to guarantee greater transparency in operations linked to charity and solidarity activities. These rules will also be valid for influencers and it is no coincidence that the law was renamed Ferragni after the investigations involving the digital entrepreneur following the Balocco pandoro case and the others that followed.

Rules

The provision provides for the obligation for producers of goods and professionals to report specific information on the packaging of products starting from the total amount allocated to charity. It must also be clarified whether the amount is predetermined or whether it is a percentage of the price of each individual product. The objective is that the consumer knows with certainty which part of the proceeds will go to solidarity initiatives as explained by the Minister for Business and Made in Italy Adolfo Urso.

The intention to carry out the promotional activity must first be communicated to the Competition Authority the deadline within which the amount will be paid to the beneficiary. Within three months of the deadline the producer must communicate the payment to the Authority.

For non-commercial entities the Third Sector code remains valid and for those linked to religious denominations, for which there is a dedicated agreement.

Fines

They are expected fines from 5 to 50 thousand euros if the indications provided for by the bill for funds which, from sales, go to charity are violated. It will be the Authority Antitrust to pay the sanctions. 50% of the amount should be allocated to solidarity initiatives, identified with a subsequent decree. Minister Urso explained this after the Council of Ministers. There will be the possibility of suspension of the activity for one year in case of repeated violations. Influencers will have to publish the sanctioning measure received on their website.
