Chapecoense CPI approves compensation to victims’ relatives and companies’ accountability

The Parliamentary Committee of Inquiry of the Senate that monitors the situation of victims and family members of the Chapecoense plane accident unanimously approved, this Monday (11), the report by Senator Izalci Lucas (PSDB-DF) with recommendations to the entities involved and responsible companies for the 2016 tragedy, which left 71 dead.

The text makes seven recommendations, among them the compensation of victims and family members and the accountability of five companies involved in a possible fraud in the issuance of the insurance policy contracted by the Bolivian airline LaMia.

The document also brings other recommendations: opening of “procedure to investigate the solvency of affiliates of Tokio Marine Kiln Limited and AON UK Limited in Brazil”, due to “negative repercussions, including financial ones, that the specific case brings, due to the deterioration of the image” of companies; improvement of operational standards and protocols for air transport of passengers, since LaMia operated for about six months without any opposition from the regulatory bodies, despite safety problems; improvement of rules and operational protocols for sports competitions, given that LaMia, even with financial and security problems, transported several football teams “without any type of scrutiny from the entities responsible for the championships”.

For the commission, it is necessary to improve the legislation on the subject. Four bills are mentioned: one amending private insurance rules in the Civil Code and three amending the Brazilian Aeronautical Code to reinforce the accountability of insurers and carriers.

The report by Izalci Lucas also concluded that there are five companies “equally responsible for compensation” to victims and family members. According to the rapporteur, legal entities had direct participation in the issuance of a possibly fraudulent insurance policy.

The companies mentioned are LaMia Corporation, headquartered in Bolivia; Bisa Seguros, also from Bolivia, with which LaMia has taken out insurance; Tokio Marine Kiln Limited, based in the United Kingdom, with which Bisa has taken out reinsurance; brokers Aon UK and Grupo Estratégica (formerly Aon Bolivia), who acted as representatives of the insurer and reinsurer and advisors for LaMia.

The rapporteur also recommended compensation “contractually and extracontractually” to the victims and family members of the victims of LaMia airline flight CP 2933, and “achieve any criminal and administrative offenses” committed by those involved in the accident.

The parliamentary commission of inquiry was installed in 2019 to assess the situation of the families of the victims of the plane crash that was transporting players, the technical commission and the board of the Chapecoense Football Association, in addition to journalists. The disaster that occurred on November 28, 2016 killed 71 people, 68 of whom were Brazilians, and six survived the tragedy.
