Chamber approves text of PEC dos Precatórios in 2nd round

In the second round, the Chamber of Deputies approved the main text of the PEC dos Precatórios on Wednesday afternoon (15) by 332 votes in favour, 141 against and 1 abstention. Now, the matter needs to be enacted, in a joint session of the National Congress, to enter into force.

Earlier, the Chamber had already concluded the vote in the 1st round, which contains the unpromulgated sections of the Senate version for the PEC dos Precatórios (PEC 23/21), as the limit for payment of these debts.

Of the seven initial highlights, only one of them was accepted, which removed from the text the dates for payment of the precatories of the Fund for Maintenance and Development of Elementary Education and the Valorization of Teaching (Fundef). This is because, according to the text approved by the Senate, there were fixed dates for payment in the years 2022, 2023 and 2024.

According to the approved text, for 2022, the application of resources saved with the limit of payment of court orders should be exclusively in social security and in the Auxílio Brasil program. The PEC also places in the Constitution, as a right of the vulnerable population, access to a basic family income, which will be permanent.

The attempt to postpone the validity of the precatory ceiling from 2026 to 2036 ended up being left behind. This is because the Chamber had approved the 2036 date and this was a point of disagreement among the deputies in relation to the text of the senators.

1st shift

On Tuesday night, the Chamber approved, in the first round, the basic text of the interventions made by the Senate in the text of the PEC dos Precatórios. There were 327 votes in favor and 147 against, and 1 abstention.

Among the points analyzed by the Chamber were the attribution of a permanent character to the Auxílio Brasil program, the linking of the fiscal space to be opened with changes in the payment of court orders to social security and the new social program, and also the limit for paying off these debts.

On Tuesday morning, an ordinance was published in an extra edition of the Federal Official Gazette (DOU), signed by the Minister of Economy, Paulo Guedes, which changes the maximum date for the commitment of funds by the federal government. With this, until December 31 of this year, it will be possible to pay funds from the 2021 Budget, such as parliamentary amendments.

According to congressmen, this was an attempt by the Federal Government to obtain the necessary votes for the approval of this second part of the PEC dos Precatório.

Last Wednesday (8), parts of the PEC dos Precatório was promulgated in a joint ceremony with presidents of the Senate, Rodrigo Pacheco (PSD-MG), and of the Chamber of Deputies, Arthur Lira (PP-AL).
