Chamber approves punishment for emotional embezzlement and digital scams

The Chamber of Deputies approved, this Thursday (4), the bill that establishes punishment for those who apply blows through social networks. The text also includes the creation of the crime of emotional embezzlement, which occurs if the victim delivers goods or values ​​as part of an affective relationship.

Deputy Deputy Lieutenant Gonzaga also proposed amending the Penal Code to include new hypotheses for the crime of embezzlement, which is the pursuit of advantage through fraud that misleads the victim: emotional embezzlement, electronic fraud, embezzlement against the elderly or vulnerable.

He stated that the crime of embezzlement was enhanced by the internet and new interactions through social networks and other applications. “The criminal uses the facility of the virtual environment to deceive his victims, which gives rise to an aggravation of the reprimand to be imposed in these cases”, said the rapporteur.

According to the text approved for embezzlement, the penalty will be increased by half if the damage is large; and increased by up to 2/3 if the criminal uses an entity governed by public law or an institute of popular economy, social assistance or charity.

The penalty will be 4 to 8 years in the case of electronic fraud using information provided by the victim or third parties through contacts on social networks, telephones or e-mail. Scams applied by cloning apps will be punished with the same penalty.

The penalty will be triple if the victim is elderly or vulnerable, a crime that will still be included in the list of heinous crimes (Law 8.072/90).

The proposal now goes to vote in the Federal Senate.
