Case Bernardo: stepmother is allowed to go to the semi -open

Sentenced to kill stepson Bernardo Boldrini in 2014, Graciele Ugulini had the regime progression authorized by the court on Thursday (17) and will pass to the semi-open regime. She received the 34 -year -old sentence and seven months in prison during trial in 2019 for quadruple -qualified homicide and corpse concealment.

The regime progression considers the requirements established by the Criminal Execution Law and was granted by Judge Geraldo Anastácio Brandeburski Júnior, of the 1st Court of the 2nd Court of Criminal Executions of the District of Porto Alegre.

In the ruling, the judge considered that Graciele reached the requirement for regime progression, for the exercise of work and educational activities.

In addition, subjective requirements would also have been identified through criminological examination, composed of social assessment and psychological evaluation.

The magistrate, however, denied the defendant’s defense request to serve the penalty in house arrest with an electronic anklet. The judge considered that “he is an accused and convicted of the practice of serious crimes-qualified homicide and concealment of corpse against 11-year-old child at the time of the facts, and with a high balance of penalty to be fulfilled. It is clear from the high balance of penalty to be fulfilled, all severe and violence, which is necessary to be more attention to the absence of his sentence, being more. Premature, therefore, the granting of house arrest, albeit under electronic monitoring ”.

The decision determined that the Superintendence of Penitentiary Services (Susepe) transfer Graciele, within five days, to prison compatible with the fixed regime.

Bernardo’s stepmother was arrested in 2014 and served 13 years, 8 months and 27 days in prison.

Remember the case

Bernardo Boldrini was 11 years old when he disappeared in Três Passos in April 2014. The body was found ten days later, buried in a grave on a property on the banks of the Mico River in the neighboring city, Frederico Westphalen.

On the same day, his father, Leandro Boldrini, and his stepmother, Graciele Ugulini, were arrested, suspected of being the intellectual mentor and the perpetrator of the crime. They would also have contact with the help of Graciele’s friend Edelvania Wirganovicz, also arrested.

Days later, Evandro Wirganovicz, Edelvania’s brother, was arrested, suspected of being the person who prepared the pit where the boy was buried. The four were submitted to a popular jury and convicted by the Jury Court. At the time, Boldrini had the trial annulled and was again submitted to a popular jury in 2023.
