Carandiru Massacre: Justice extinguishes sentences of convicted police officers

The Court of Justice of São Paulo (TJ-SP) This month, this month, all sentences of the 74 military police officers convicted of the Carandiru massacre were extinguished which took place in the capital of São Paulo on October 2, 1992.

The decision was taken after the pardon granted by then president Jair Bolsonaro (PL), in 2022, which pardoned the sentences imposed on the defendants. The massacre left 111 inmates dead during a riot in pavilion 9 of the extinct São Paulo Detention House.

The case, which marked the history of the Brazilian prison system, resulted in the conviction of the military police officers by a popular jury, with sentences ranging from 48 to 632 years in prison.

However, the presidential pardon, which had already been considered constitutional in August by the TJ-SP, has now been officially reaffirmed, eliminating once and for all the punishments of those involved.

Six trials have taken place since then. In the first trial, in 2001, Colonel Ubiratan Guimarães, who commanded the operation, was sentenced to 632 years in prison for the deaths of 102 of the 111 prisoners in the penitentiary complex.

The other trials took place in 2013 and 2014. As it was a process that involved a large number of victims and defendants, the trial was divided into four parts and, at the end of which, 74 police officers were convicted of the 111 deaths, with sentences ranging from 48 to 624 years in prison.

What happened to the House of Detention

The House of Detention was deactivated in 2002. The decision came after a rebellion, which occurred the previous year, in 29 prison units in the state of São Paulo. Still in 2002, three Carandiru pavilions were imploded.

Another two of the four pavilions that remained were imploded in 2005. The area where the penitentiary operated gave way to the Youth Park.

In the two pavilions that remained standing, the State Technical School (Etec) of Arts and the Etec Youth Park currently operate.
