The Brazilian Association of Criminal Lawyers (Abracrim) filed a complaint with the National Council of Justice (CNJ) against Judge Carlos Alberto Garcete, who expelled a lawyer from a hearing in Campo Grande.
Abracrim’s allegation pointed out that there was “disrespectful, humiliating and prejudiced conduct” before lawyers Willer Souza Alvez de Almeida and Pablo Arthur Buarque Gusmão.
The case took place on May 19. During a session in Campo Grande, Judge Carlos Alberto Garcete asked to remove Willer Almeida from the hearing, after the lawyer offered a glass of water to one of the witnesses.
Then another lawyer, Pablo Gusmão, spoke in defense of his partner, but he also had to leave the hearing after the judge determined.
After the run, Willer Almeida said he was ashamed of the situation and also said that the situation is a portrait of veiled racism in Brazil.
“It must be remembered that there is no hierarchy between judge, prosecutor and lawyer. Everyone is on the same equal footing. So a lawyer is not subordinate to a judge. And then I cannot say that there is explicit racism, but that is what happens in Brazil, that veiled racism. Why was only the black lawyer with the braid removed with police force while the other was not? Why are black lawyers so disrespected?” he said.
“In Brazil, we have a deplorable cultural issue of thinking that black people are less. So I wouldn’t say explicit, but the question remains: why is the black lawyer removed from the police force? Because we have the habit of thinking that blacks are dangerous or something like that. I’m just a lawyer doing my job and demanding respect in my profession.”
Willer Almeida also recalls that his partner was unable to continue defending the client. “He takes a stand, raises the question of order, informs that he will activate the prerogatives, and just because he informed that he would activate the prerogatives, the judge also ordered him to be removed from the hearing, leaving our client unassisted in the session.”
By means of a note, the Magistrates Association of Mato Grosso do Sul (Amamsul) expressed support for the decision of state judge Carlos Alberto Garcete.
According to Amamsul, it is “the duty of each and every judge, when presiding over the hearing, to maintain the regularity of the work, discipline and decorum during the course of the process, avoiding the practice of acts capable of jeopardizing the regular processing of the case”.
Finally, the association said that “emphasizes the absolute respect for the prerogatives of the law, however, clarifies that such cannot be used to corroborate wrong postures of the professionals, it is up to the magistrates, in hearings, to ensure the discipline of the procedural act”.
Sought, the CNJ said that, so far, it had no information about the opening of the process. The Court of Justice (TJ) and the Brazilian Bar Association (OAB) have yet to comment.
