Arrested this Monday (11) after being caught raping a patient during her own delivery, anesthesiologist Giovanni Quintella Bezerra is a defendant in a lawsuit filed by a patient who accuses him of misdiagnosing.
She accuses Bezerra, two other doctors, a private hospital in Duque de Caxias, a city in the Baixada Fluminense, and a health plan of misdiagnosing H1N1, known as swine flu, in 2018.
On July 6, 2018, when receiving a patient who for the second day reported being short of breath, vertigo, delirium, coughing up blood and headaches, the doctor stated that the woman was suffering from an anxiety crisis and suggested that she looked for a psychologist.
The patient claims to have reported to the doctor that she was already using medication and had severe symptoms, however, she points out that the doctor did not refer her for any exam, not even an x-ray.
Without also receiving adequate care from a third doctor, the patient was hospitalized that month with severe pneumonia that was later found to be swine flu. It was 13 days in a coma. In the period, a thrombosis and complications that led her to lose part of the movement of her legs – today, a woman needs a walker to get around. She also reports that she asked for her two jobs and had to drop out of college when she became ill.
Giovanni Quintella Bezerra was summoned, but did not present a defense in the process. The case has been pending in the Rio de Janeiro Courts since 2019 and the patient is represented by Garcia & Poell Advocacia e Consultoria Jurídica.
She claims to have suffered moral, psychological and aesthetic damage as a result of the negligence of the doctors, demands compensation and a lifetime pension, as she justifies being unable to work. THE CNN awaits contact from Giovanni Quintella Bezerra’s defense.

Giovanni Quintella Bezerra was arrested for rape of a vulnerable person, in the early hours of this Monday (11), at the State Hospital for Women Heloneida Studart, in São João de Meriti, in Baixada Fluminense. He undergoes a custody hearing at 1 pm this Tuesday (12).
