Ana Hickmann’s request for divorce under the Maria da Penha Law was denied in court

The São Paulo Court denied the request to process the divorce between presenter Ana Hickmann and Alexandre Correa by the 1st Criminal and Domestic and Family Violence Court, based on the Maria da Penha Law.

Following the Public Prosecutor’s Office’s statement, the judge responsible for the decision ordered the immediate referral of the case to a Family Court. A CNN had access to the decision, which is confidential.

“Furthermore, despite the seriousness of the facts contained in the precautionary measure and the clear animosity between the victim and the alleged aggressor, (…) these are highly complex and specialized issues, which go beyond the limits and parameters limited to the criminal jurisdiction or related to the rite of expediting cases involving domestic and family violence against women”, explains the magistrate in an excerpt of the order.

The judge also cited the possible custody and visitation process for the couple’s minor child, which would also be outside the jurisdiction of the Domestic Violence Court.

Ana Hickmann had filed for divorce based on the Maria da Penha Law, in order to speed up the separation. The information was confirmed by the presenter herself in an interview shown on Sunday (26) on TV Record.

The former model had also requested an urgent protective measure against Alexandre Correa, after initially denying protection.

Ana Hickmann’s advisor was contacted to comment on the court decision, but did not return contacts made by CNN so far, as has Alexandre Correa’s defense.

The allegation of assault

The presenter registered a police report for aggression against the businessman on the 11th.

She told the police that she was at the family home in Itu, in the interior of São Paulo, talking to her 10-year-old son, when Correa heard it and didn’t like the subject. Therefore, an argument began. The child, frightened, would have run out of the room.

According to the former model, Correa pushed her against the wall and threatened to headbutt her. According to police records, Correa closed the kitchen door and hit Hickmann. The military police were called and the presenter had to seek medical help because of the injury to her arm.

The businessman even denied the accusations on social media, but later regretted the fact.

According to Alexandre Correa’s defense, the court requested the revocation of the protective measure in favor of Ana Hickmann. Lawyer Enio Martins Murad also filed a lawsuit against the presenter for parental alienation.

Correa’s defense claims that he was asked for the right to visit the couple’s 10-year-old son, but the request was denied by the presenter, “so there was no alternative other than the appropriate legal measure”, he explained.
