Singer Ana Castela was sued by composer Luan Kaique Vieira Castelan, who claims that her song “Lado Direito da Cama” was plagiarized in the version “Solteiro Forçado”, one of the hits from “Boiadeira”. The musician is asking for compensation of R$200,000, for the song not to be part of the shows and for the defendants to portray themselves on social media.
The process began this month in the São Paulo Courts. In addition to the singer, eight other people are named as authors or editors of the supposedly planned song, according to the records of the Brazilian Music and Arts Association (Abramus).
Luan alleges that the defendants used the basis of the composition and took advantage of the situation, without any authorization. The action seeks compensation for moral and material damages, for plagiarism of a literary work, publication on the internet and in pre-university booklets, containing texts from the work without prior authorization from the author. “The defendants profit absurdly, because, by publishing it on the platforms, they obtained an exorbitant number of views, unduly, without the express disclosure of the author’s name in the work”, alleges the action.
What Luan Kaique Vieira Castelan asks for
- Music credit on all audio and video platforms to retain or reserve revenue credit, with a daily fine of R$40,000 in case of non-compliance.
- Defendants do not sing the song “Solteiro Forçado” in their shows, until the case is judged, with a fine of R$200 thousand reais for each time it was played on stage.
- Musicians pay R$200,000 for plagiarism, in addition to payment for material damage to be calculated for displaying the music on audio and streaming platforms.
- Portrayed on websites, social networks (Instagram and Facebook), and in three newspapers with large national circulation.
“Right Side”
The country singer would have been aware of the plagiarism that occurred in May 2013. The process states that the author composed the music and registered the work with the competent bodies in December 2019.
The defense alleges similarities in the melody and aesthetics of the clip, such as the presentation accompanied by guitar, piano and blue theme. The song was recorded on the singer’s DVD, which is available on YouTube, three years ago. The video has almost 90 thousand views and more than a thousand likes.
With more than 160 million views, Ana Castela’s music video was published 5 months ago and has accumulated more than 800 thousand likes on YouTube.
Luan’s defense states, in a statement, that the artist was surprised by the release of the song on music and video platforms without due credit.
In the plagiarism process, it is stated that the author has been composing since he was twelve years old and intends to become a country music star through his compositions and interpretations in the world of art.
“The author believes in his potential in his musical journey, dedicating himself 24 hours a day and being inspired by artists who left poverty and achieved success due to the talent he has with the compositions that achieved success in Brazil and abroad”, he states the action.
